The Origin

The position of Attorney General was created by the Judiciary Act of 1789. As head of the Department of Justice, the Attorney General manages and oversees all US Attorneys and other counsel members employed by the US. In basic terms, the Office of the Attorney General controls various counterparts of the Department of Justice, including the FBI, DEA, Bureau of Alcohol, Tobacco, Bureau of Prisons, Office of Justice Programs, the U.S. Attorneys and U.S. Marshals Service, and of course Firearms and Explosives.

The Responsibilities

So what is the Attorney General actually responsible for doing other than overseeing and managing the Dept. of Justice? Here are some of his/her duties:

  • Representation of the United States with any legal cases
  • Provide both formal and informal feedback and advice on any legal matters with the President, the Cabinet, and any departments or agencies within the US government
  • Provide advice to the President with any matters involving federal judicial positions and positions within the Department

The Second Amendment

In regard to the gun ownership, McMahon states, “I am a Second Amendment Advocate. Citizens have the right to Keep and Bear Arms under the Second Amendment to the US Constitution; and also under Article XVII of the Massachusetts State Constitution. This is a clear civil right worth fighting for.”

McMahon focuses on the importance of legal and lawful gun ownership, “Licensed gun owners do not commit gun crimes. Their guns are not “on the streets”. This AG’s policy against lawful gun owners does nothing to stop crime or enhance public safety.” What’s better is that he even said “You will not have to sue me in order to exercise your Constitutional “God-given Rights”… Your rights, and your guns, are safe with me.”
